DOD Makes Dangerous Recommendations to Overhaul the UMCJ

12/30/2015

Comments

The Military Justice Review Group - a DOD created advisory board has made some dangerous recommendations for what appears to be a near overhaul of the UCMJ

Service members should fear most the creation of Judge only special courts-martial that can impose up to 6 months confinement.  They also want to move military practice closer to federal practice with sentencing guidelines and judge alone sentencing.  It's obvious what is going on - DOD wants to take power away from juries and stack the deck for longer sentences.

I personally don't have any tolerance for proposed laws that aim to dilute the power of juries.
